A Beginner’s Guide to the CHL vs. NCAA Recruiting Battle

By now, especially if you read this blog, you’ve probably heard about the Kitchener Rangers v. The Michigan Daily lawsuit that appears to be on the brink of being heard in court. So you might be wondering why or how it matters in the big picture.

One of the key matters at hand is the ongoing recruiting battle that pits teams in the Canadian Hockey League against schools in American college hockey. It has become an increasingly ugly affair between two of the most prominent developmental routes to the National Hockey League.

One considers itself the “fastest route” to the NHL, while the other feels it provides players with more well-rounded development from both a hockey and personal standpoint. While there are benefits and downsides to both routes, neither can definitively call itself “The Best Way to the NHL.”

In the world of player development, there are so many factors at play that make up how a player reaches his full potential. While each developmental path can provide the tools to a player to make it to hockey’s pinnacle, it’s essentially on the player to either make it or not.

There isn’t a coach in the world that is good enough to put every player he comes across into the NHL. It’s just not possible. If a player has the tools and the upside, he either finds a way to the pros or he doesn’t. In many cases, the player would or would’t have made it no matter which route he chose.

However, the recruiting battle has almost nothing to do with player development and everything to do with wins and money.

[UPDATED] Michigan Daily Officially Served Libel Notice, What’s Next?

The ongoing saga that is the Kitchener Rangers lawsuit against The Michigan Daily, student reporter Matt Slovin and his anonymous source took a more official turn today as the student paper and reporter were officially served with a libel notice today, according to Sunaya Sapurji.

Now that the the defendants have been served, it looks like there’s a good chance this is going to court.

Michigan Daily Attorney: Kitchener Using Bully Tactics Against Student Paper, Reporter

In a radio interview with SN590 AM in Toronto, Herschel Fink, the attorney representing The Michigan Daily and student-reporter Matt Slovin revealed that the newspaper has yet to be served with anything by the Kitchener Rangers, which reportedly filed a lawsuit Tuesday.

Now there’s still a good chance the paper simply hasn’t been served yet and will be, but without having seen the case, Fink could only detail what he has seen through media reports. However the attorney revealed quite a bit about what he thinks about of the Rangers’ case.

Summer College Hockey Roundup: Hockey City Classic, Bjugstad Stays in School, UMess & More

Though the Kitchener v. Michigan Daily kerfuffle has consumed much of the blog of late, there has been plenty of other significant goings on in college hockey the last few weeks.

From another announced outdoor game to a mess of a coaching search at UMass to one of the best players in college hockey announcing he’ll return to school, there’s been a lot to get to.

Though in comparison to last summer’s blow-everything-up bash that was realignment, this year is a bit tamer in terms of news, unless you’re a big fan of libel lawsuits.

[UPDATED] Michigan Daily Issues Statement, Stands By Report as Lawsuit Looms

Thursday night, The Michigan Daily issued a statement in response to the Ontario Hockey League’s Kitchener Rangers lawsuit against the paper, student-reporter Matt Slovin and his anonymous source.

The statement reads in full:

On June 28 The Michigan Daily published an article on its website that said hockey player Jacob Trouba was considering an offer to play for the Kitchener Rangers of the Ontario Hockey League. The article was updated to include further developments on July 2, July 3 and July 4. The Rangers and the Trouba family have denied the offer, and the Rangers have threatened legal action. The Daily stands behind the story and the reporter, Matt Slovin. The Daily will respond to threats of legal action in an appropriate fashion.

So it’s game on now. Kitchener has filed its suit and the Daily has now publicly affirmed its story. This is probably not the result the Kitchener Rangers were expecting. So now it’s on them to pursue the case or drop it.

Some analysis of the case was covered earlier today on USofH and why this lawsuit may be more trouble for Kitchener and the Ontario Hockey League than its worth.

The Rangers may be backed into a corner now into where they have to stand by their word and pursue this case despite the fact that it is unlikely they will be able to collect damages. This is due to the SPEECH Act protecting U.S. media outlets from foreign libel/defamation judgments so long as the report satisfies First Amendment standards. Should the Daily lose the case, most likely the worst that will happen is the defendants would be denied entry into Canada due to the outstanding judgment (via Student Press Law Center).

This case has so many different angles of importance from how the Canadian Hockey League’s member leagues and clubs do their business to NCAA vs. CHL recruitment to journalism ethics and “libel tourism.” The eyes of more than just the hockey world will be fixed on these proceedings.

The United States of Hockey will be following Kitchener Rangers Junior A Hockey Club v. The Michigan Daily, Matt Slovin and John Doe very closely and will provide updates as they become available.

Kitchener’s Lawsuit Could Put Whole System on Trial

It’s been two days since the Kitchener Rangers filed suit against The Michigan Daily and student reporter Matt Slovin, and other details continue to trickle out regarding the legal proceedings.

The Student Press Law Center recently reported on the latest, including the fact that a “John Doe” was also named in the suit by the Rangers, with John Doe being Slovin’s anonymous OHL source. This revelation is not much of a surprise as this suit, claiming in excess of $1 million in damages, has very little to do with money.

In addition to defending its reputation against the report, Kitchener undoubtedly wants John Doe revealed. Ryder Gilliland, the lawyer representing the Rangers in the suit told this to Sunaya Sapurji of Y! Sports Canada:

“When you’re dealing with sources one thing you have to be very careful about is relying on a source that has a bone to pick,” said Gilliland. “The Kitchener Rangers are very concerned – they don’t know who the source is – they’re concerned that… this was a source that was deliberately trying to cause harm to the Kitchener Rangers. Again, we don’t know if that’s the case, but that’s a very real concern.”

I’m unfamiliar with Canada’s laws in terms of the protection of anonymous sources, but it might not matter anyway.

U.S. Hockey Hall of Fame Class of 2012 Unveiled

USA Hockey announced the U.S. Hockey Hall of Fame Class of 2012 earlier Tuesday. The class includes former Minnesota North Stars/Dallas Star great Mike Modano, longtime NHLer and current NBC color analyst Eddie Olczyk, and New Jersey Devils president, CEO and GM Lou Lamoriello.

The Class of 2012 is certainly a deserved one. Each has had a significant impact on American hockey in their own ways and all have been involved in USA Hockey in some capacity internationally.

I thought we’d see a bit of a bigger class this year due to the sheer volume of worthy candidates, but I think the committee came up with a very strong group. These three men will be inducted some time in the fall, as a date and location for the ceremony have yet to be revealed.

[UPDATED] Kitchener Apparently Suing Michigan Daily Over Trouba Report

Last week, the student newspaper at the University of Michigan, The Michigan Daily ran a report that Winnipeg Jets first-round pick and Wolverine-commit Jacob Trouba was offered $200,000 to sign with the Kitchener Rangers. Trouba’s family came out to vehemently deny the report, while Kitchener threatened legal action.

According to a report filed by Josh Brown of the Waterloo Region Record, Kitchener is following through on those threats. From Brown’s report:

The Kitchener Rangers are taking action against a Michigan student newspaper and one of its reporters after a story surfaced alleging the team had offered to pay to bring a player to the club.

“It’s not a threat anymore,” said Rangers chief operating officer Steve Bienkowski. “We served the newspaper and the writer there to either back it up or retract it.”

“Our intent is that we will file a statement of claim for damages,” said Bienkowski, who retained Blakes law firm hours after the story was published. “We have to look at every option we have. Where it ends up, who knows?”

Who knows, indeed. Libel and defamation lawsuits are tough to win no matter in the U.S. or Canada. Either way, Kitchener has taken a step it never took against Jeff Jackson when the Notre Dame head coach alleged Kitchener offered current Anaheim Ducks defenseman Cam Fowler $500,000, despite threats of suing.

USofH on the Air: Talking U.S. Ivan Hlinka Team with The Pipeline Show (7/7)

I’ll be joining the fellas over at The Pipeline Show on TEAM 1260 in Edmonton to chat about the recently announced U.S. Under-18 Select Team that will be participating at the 2012 Memorial of Ivan Hlinka tournament in the Czech Republic and Slovakia this August.

I’ll have an in-depth preview of the team USA Hockey is sending to the Hlinka on the blog a little closer to tournament time, but you can get a quick preview of that on TPS today at 1:40 p.m. ET.

The team is made up of many of the top 1995-born U.S. players outside of the National Team Development Program and includes many notable prospects for the 2013 and 2014 NHL Entry Drafts.

A Celebration of America in Pictures of Bald Eagles

If you’ve been a frequenter of this blog, you have probably noticed that most of the posts are about the United States of America and Americans, typically about the hockey played within it and by them.

It’s a great time to be an American hockey fan and it’s always a great time to be American, which is why I decided to have a little Independence Day fun here at United States of Hockey. This is definitely not your normal USofH post. Hockey can take a break for one day, right? I mean, as long as Zach Parise and Ryan Suter haven’t signed yet, And since great Americans Zach Parise and Ryan Suter have decided to join forces, we can all have a little fun I think.

Everyone knows that the bald eagle is one of the great symbols of America. Stoic, strong, majestic, free. Coming up after the jump, A Celebration of America in Pictures of Bald Eagles. Happy Independence Day, everyone!
